The Pakistan Bar Council (PBC) has decided to file a review petition in the Supreme Court in Justice Qazi Faez Isa case.
The PBC will file review petition in the apex court’s decision to send the issue of the properties of wife and children of Justice Faez Isa to the Federal Board of Revenue (FBR), Vice Chairman Abid Saqi said, adding that Justice Isa and his wife had already opposed sending the matter to the FBR. The PBC will file the petition after announcement of detailed judgment by the apex court, he said. “The FBR is not likely to conduct an impartial and transparent inquiry under the government pressure,” he added.
While accepting the petitioner’s plea on Friday, the Supreme Court had dismissed the presidential reference against Justice Isa after declaring it ‘invalid’. A 10-judge bench of the apex court headed by Justice Umar Ata Bandial had also withdrawn the show-cause notice issued by the Supreme Judicial Council (SJC) to Justice Isa in July 2019 over writing letters to the president.
In its 11-page short order, the top court had ordered inland revenue commissioner to issue a notice to the judge’s family members including his wife and children within seven days to seek details of their properties.
Meanwhile, renowned law expert Barrister Aitzaz Ahsan has said that assets issue of Justice Qazi Faiz Isa and his wife still stands unresolved. He told a private TV channel that it is beyond comprehension that under what powers the court referred the case to the FBR. He held that the court has no authority to refer the matter to the FBR. Imposing any restrictions on the FBR is also in no way in consistent with the law, he added.
